Paisagia terms of use

01Definitions

For the purposes of these Terms of Use, the following definitions apply:

• "Paisagia" or "we": the AI-powered landscape design platform offered at paisagia.com.br and paisagia.com, operated by Bliz Soluções Digitais LTDA, registered in Brazil under CNPJ no. 22.117.215/0001-20, with its registered office at Ed. Impacto Empresarial, Av. Nossa Sra. da Penha, 2796, 8º andar, Santa Luíza, Vitória – ES, Brazil;
• "User": Individual or legal entity that uses our services;
• "Services": All functionalities offered by the Paisagia platform;
• "Account": User profile registered on our platform;
• "Content": All information, images, texts, and data provided or generated.

02Acceptance of Terms

The sign-up and sign-in pages state that, by continuing, you agree to these Terms and to the Privacy Policy. Your express acceptance is given at the profile step, which is mandatory to use the platform and comes after you purchase a plan, by ticking the acceptance box. We record the date, the IP address and the version (publication date) of the Terms and the Policy you accepted. If you do not agree, do not use the services; if you have already paid, you may withdraw under the 7-day guarantee (section 9).

These terms constitute a legally binding agreement between you and Paisagia.

03Description of Services

Paisagia offers landscape design services using artificial intelligence through four main modes:

• Freestyle Mode: Automatic creation based on preferences and environment photo;
• With Prompt: Image generation from the photo of the space and a description you write;
• Clear Space: Removal of vegetation, furniture and debris from images of the space, with the ground finished as bare soil or grass;
• Garden Editor: Manual element placement with AI finalization.

Images are produced by external artificial-intelligence providers (see the Privacy Policy) and vary from one generation to the next. We reserve the right to modify, suspend, or discontinue any functionality at any time.

In the app, Paisagia's virtual assistant answers questions about the platform, your account, your plan and billing, and about gardens and landscaping. It is an artificial intelligence, not a person. When a ticket is open, someone on our team may also write in the conversation on its behalf. Its answers may be incomplete or wrong and do not replace advice from our team or from a professional where that matters, such as a landscaping decision for the real space (see section 7). About your account and billing, it answers within what it can look up, and it does not change your account, plan or payments; for what it cannot settle, you can contact our team. Help with the account is available to every active account; the conversation about each scene, in the editor, on the plans that include it. In the editor, it may propose an edit of the scene's photo; the edit is only made when you press the card's button, and it uses one generation of your plan. The assistant has limits on messages per minute and per day and may be unavailable. What you write to it and the images you attach are handled as the Privacy Policy describes (sections 6 and 8).

04Registration and User Account

To use our services, you must:

• Provide true, accurate, and up-to-date information;
• Maintain the confidentiality of your access credentials;
• Be responsible for all activities performed on your account;
• Notify us immediately of any unauthorized use.

Your account is created immediately, with no prior approval. Using the tools requires an active plan (a paid subscription, a trial or access granted by our team) and a completed profile. We may suspend or close accounts that breach these Terms (see section 11).

05Rights and Intellectual Property

5.1 Paisagia Ownership

Paisagia holds all rights, titles, and interests in the platform and its components, including but not limited to:

• Technology and system architecture
• The way the platform uses artificial intelligence (instructions, workflows and settings), without prejudice to the suppliers' rights over the third-party models we use
• User interface and user experience (UI/UX)
• Original content, documentation, and training materials
• Brand, logo, visual identity, and graphic elements
• Databases, image libraries, and digital assets

All these elements are protected by copyright, intellectual property laws, trade secrets, and other applicable legislation in Brazil and internationally.

5.2 Source Code and Software

The source code of the Paisagia platform, including HTML, CSS, JavaScript, backend, APIs, and any other software component, is exclusive and confidential property of Paisagia. It is expressly prohibited to:

• Copy, reproduce, or redistribute any part of the source code
• Modify, adapt, or create derivative works of the software
• Inspect the code with automated tools for extraction or competitive analysis
• Remove or alter intellectual property notices from the code
• Use the code as a basis for developing competing platforms

Violations of these restrictions will be treated with maximum legal rigor, including applicable civil and criminal actions.

5.3 Design and Visual Interface

All design elements of the platform are protected by copyright and constitute intellectual property of Paisagia:

• Page layout and navigation structure
• Color schemes, palettes, and characteristic gradients
• Typography, visual hierarchy, and spacing
• Visual components, buttons, cards, and interactive elements
• Animations, transitions, and visual effects
• Custom icons and proprietary illustrations

Any reproduction, imitation, or use of design elements without express authorization constitutes copyright infringement.

5.4 Brand and Visual Identity

The name "Paisagia", its logos, trademarks, and all visual identity are exclusive and protected property. It is prohibited to:

• Use the name "Paisagia" or variations in products or services without authorization
• Reproduce, modify, or distribute the Paisagia logo
• Create visual identities that cause confusion or improper association with the brand
• Use the brand in domains, social media profiles, or unauthorized promotional materials
• Register similar or confusingly similar trademarks or trade names

Paisagia reserves the right to take immediate legal action against unauthorized use of the brand, including removal requests, indemnifications, and other legal penalties.

5.5 Database and Digital Assets

All databases, content libraries, and digital assets of the platform are protected as intellectual property:

• Libraries of plants, trees, shrubs, and landscape elements
• Catalog of textures, floors, coatings, and materials
• Instructions (prompts) and settings used to generate images
• Proprietary images, photographs, and renderings
• Metadata, tags, and categorization systems

Systematic extraction, mass downloading, scraping, or any form of unauthorized reproduction of these assets is prohibited. Access is granted exclusively for use within the platform according to your subscription plan.

5.6 Prohibition of Reverse Engineering

You expressly agree NOT to perform, directly or indirectly, any of the following actions:

• Decompile, disassemble, or reverse engineer any part of the system
• Attempt to discover the source code, algorithms, or technological structure of the platform
• Create automated tools to extract functionalities or data from the system
• Perform network traffic analysis to intercept communications or data
• Circumvent security measures, technical limitations, or access controls
• Use the platform to develop competitive products or services

Reverse engineering attempts will result in immediate account suspension and legal action for intellectual property violation and breach of trade secrets.

5.7 User Content

You retain ownership rights over the images and information you provide to the platform. By using our services, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process your images and texts and send them to the artificial-intelligence providers named in the Privacy Policy, solely to produce the images you request and the virtual assistant's answers
• Store your content for as long as your account exists, or until you delete it, and display it to you on the platform
• Allow our team to access your content when needed for support, security, billing, fixing errors or improving the virtual assistant's answers

You represent and warrant that you have all necessary rights over the content provided and that it does not violate third-party rights. Paisagia will not claim ownership of your original images and does not use them to train artificial-intelligence models.

5.8 AI-Generated Projects

Landscape projects created by artificial intelligence are the result of combining your input with our proprietary technology:

• Usage rights: You may use finished projects and images commercially, on any plan, including presenting and selling them to your clients
• Shared ownership: Projects incorporate our technology, algorithms, and assets, with Paisagia retaining rights over the creation methodology
• Restrictions: You may not resell or redistribute projects as templates or digital products without specific agreement
• Attribution: In public commercial use, it is recommended (but not required) to mention "Created with Paisagia"

5.9 Limited Use License

Paisagia grants you a personal, limited, non-exclusive, non-transferable, and revocable license to use the platform, subject to the following conditions:

• Personal or business use: Only for purposes authorized by your subscription plan
• Non-transferable: The license cannot be sublicensed, sold, or transferred to third parties
• Technical limitations: Respect usage limits, quotas, and restrictions of your plan
• Compliance: Use in compliance with these Terms and applicable legislation
• Revocation: The license is automatically revoked in case of violation of these terms

This license does NOT grant any ownership rights over the platform, technology, or content of Paisagia.

5.10 Intellectual Property Violations

Any violation of Paisagia intellectual property rights will result in:

• Immediate suspension: Account deactivation and access to services
• Legal actions: Civil proceedings for copyright infringement, unfair competition, and breach of trade secrets
• Indemnifications: Compensation for material and moral damages, lost profits, and unjust enrichment
• Precautionary measures: Search and seizure, account blocking, and removal of infringing content
• Criminal liability: Communication to competent authorities when applicable

Paisagia will actively monitor violations and take all available legal measures to protect its intellectual property.

5.11 Reporting Intellectual Property Violations

If you believe your copyrights have been violated by content available on the platform, or if you wish to report violations of Paisagia rights, please contact us through:

• Official email: legal@paisagia.com
• Subject: "Intellectual Property Violation - [Description]"
• Required information:
  • Identification of the protected work
  • Location of the infringing content
  • Your complete contact information
  • Good faith declaration of the violation
  • Proof of rights ownership
• Response time: Up to 15 business days for analysis and action

Bad faith or false reports may result in civil and criminal liability of the reporter.

06User Responsibilities

The user agrees to:

• Use the services legally and ethically;
• Not upload content that violates third-party rights, including photos of people or properties you are not authorized to use;
• Not attempt to circumvent technical or plan limitations;
• Not use the service for illegal or harmful purposes;
• Respect usage limits according to your subscription plan;
• Not reproduce, distribute, or modify our technology.

07Limitations of Liability

Paisagia is not responsible for:

• Temporary service interruptions due to maintenance or to the unavailability of suppliers, such as the artificial-intelligence and payment providers;
• Results that do not fully meet expectations;
• Implementation decisions based on generated projects or on the virtual assistant's answers;
• Compliance with local construction regulations;
• Technical feasibility of projects in real environments.

Our liability is limited to the amount paid for the service in the 12 months prior to the event.

08Privacy and Data Protection

Personal data processing follows our Privacy Policy and the General Data Protection Law (LGPD). Main commitments:

• Collection of only data necessary for the service;
• Use of appropriate security measures;
• Sharing only with the suppliers the services need (payments, hosting, sending e-mail, AI image generation and the virtual assistant's answers), with the partner seller who referred you, within the limits of the Privacy Policy, and when required by law; we never sell your data;
• Right to access and correct your data, exercised by writing to legal@paisagia.com, and to have your account and data deleted, asked for at support@paisagia.com or in a ticket in the support conversation (section 11);
• Data retention only for the necessary time.

09Plans and Payments

Services are offered through subscription plans with different features and limits. The conditions are:

• AI generation allowance: each plan includes a number of AI generations per month, shown on the plans page. The allowance renews every month, the annual plan included, and unused generations do not carry over to the next month.
• Billing: monthly or annual, according to the chosen plan. The annual plan is paid in full at the start of the period. Prices are in Brazilian reais (R$) on the Portuguese site and in US dollars (US$) on the English and Spanish sites; after the first charge, the account's currency does not change. Online payments are processed by Stripe, on Stripe's own payment page: your card details never pass through our servers.
• Automatic renewal: the subscription renews at the end of each period and is charged to the payment method on file until it is canceled. On the annual plan, we notify you by email 15 days before each renewal.
• 7-day guarantee: within 7 days of the subscription's first payment, you may withdraw by writing to support@paisagia.com. We refund in full what was paid in that period and end the subscription and your access to the plan immediately.
• Cancellation: outside the guarantee, you may cancel at any time with the "Cancel subscription" button on your account's billing page, which opens Stripe's payment portal; if a plan change is scheduled, undo it first. The cancellation takes effect at the end of the period already paid, with access to the plan until then, and the current period is not refunded.
• Plan changes: moving to a higher plan takes effect immediately and is charged in proportion to the rest of the period. Moving to a lower plan takes effect at the next renewal.
• Prices: prices may change. A change that affects your subscription will be announced in advance, before you are charged the new amount.
• Trials: a free trial announced on the site or offered through an invitation link is for new accounts only — the link's, when there is one, in place of the announced one; our team may also grant a trial to an account. A trial has a monthly AI generation allowance, asks for no payment method and may be limited per internet connection; a discount coupon you received applies to the first payment. When the trial ends, access ends with no charge; subscribing during the trial ends it and starts billing.
• Coupons: unless the offer says otherwise, coupons and promotion codes apply to the first purchase only.
• Payment outside Stripe: by arrangement with our team, an invoice may be paid in cash, by direct Pix, by bank transfer or on a card terminal. We record the payment, and the invoice is then shown as paid.
• Exclusive access (external sale): when you purchase directly from our team, outside the website, you receive a single-use activation link or the access is applied to your account. This access lasts one period of the chosen plan and ends with it, with no automatic renewal; to continue, you add a card on the billing page, and the subscription then renews like any other. The 7-day guarantee also applies to this purchase.

10Terms Modifications

We may update these terms periodically. Significant changes will be communicated 30 days in advance through:

• Email notification to registered users;
• Publication of the new version on this page, with the date of the last update.

Continued use of services after modifications constitutes acceptance of the new terms.

11Termination

This agreement may be terminated:

• By you, at any time: by canceling your subscription (section 9) and, if you wish, by asking for your account to be deleted at support@paisagia.com or in a ticket in the support conversation while signed in to your account (see the Privacy Policy);
• By us, in case of violation of these terms;
• By us, with 30 days prior notice;
• By the opening of a payment dispute (chargeback) with your card issuer, which cancels the subscription immediately.

The end of a subscription does not delete your account or your projects, which remain stored; access to them, including downloading images, returns when you have an active plan again. Your account and content are deleted only at your request, as described in the Privacy Policy.

12General Provisions

These terms are governed by Brazilian law. Legal matters will be resolved by the court of São Paulo/SP.

If any provision is considered invalid, the others will remain in full force.

This agreement constitutes the complete understanding between the parties regarding the use of Paisagia services.
